Please read these Terms and Conditions carefully before using the LilTots mobile application and website. By creating an account or using any part of the Platform, you agree to be bound by these Terms. LilTots is operated by LilTots Pty Ltd (ABN to be inserted).

1.1 LilTots is a peer-to-peer online marketplace that allows registered users to buy and sell pre-loved baby and children's items within Australia. 1.2 LilTots is a platform provider only. We do not own, inspect, verify, or take possession of any items listed or sold on the Platform. All transactions are directly between buyers and sellers. 1.3 LilTots does not guarantee the quality, safety, accuracy of description, or legality of items listed, the ability of sellers to sell, or the ability of buyers to pay. 1.4 These Terms are governed by the laws of the State of Queensland, Australia and the applicable laws of the Commonwealth of Australia, including the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
2. Eligibility
2.1 You must be at least 18 years of age to create an account and use the Platform. 2.2 By registering, you confirm that you are 18 years of age or older. 2.3 You must be located in Australia to sell items on the Platform. Buyers must be in the same country as the seller. 2.4 You must provide accurate, current, and complete information during registration and keep your account details up to date. 2.5 LilTots reserves the right to refuse registration or terminate any account at its sole discretion.
3. Account Registration and Security
3.1 You are responsible for maintaining the confidentiality of your account credentials. 3.2 You are responsible for all activity that occurs under your account. 3.3 You must notify us immediately at support@liltotsapp.com if you suspect any unauthorised use of your account. 3.4 You must not share your account with any other person or create multiple accounts. 3.5 LilTots may suspend or terminate your account if we reasonably believe your account security has been compromised.
4. Personal Sellers Only
4.1 LilTots is exclusively for individual private sellers selling their own personal pre-loved items. The Platform is not available for commercial use. 4.2 The following are strictly prohibited and will result in immediate account suspension or permanent ban: • Selling new commercial stock, wholesale products, or retail inventory • Operating a retail business, brand, or online store through LilTots • Listing items that were purchased specifically for the purpose of resale (arbitrage) • Promoting an external business, website, or social media store within listings or your profile • Holding an ABN and conducting commercial trading activity through the Platform • Listing handmade items created for commercial sale 4.3 LilTots reserves the right to remove any listing or suspend any account that appears to be operating in a commercial capacity without warning.
5. Listings
5.1 Sellers are solely responsible for the accuracy, completeness, and legality of their listings. 5.2 By creating a listing, you confirm that: • You are the owner of the item and have the right to sell it • The item description, photos, and condition accurately represent the item • The item is not prohibited under these Terms or any applicable law • The item is safe for its intended use 5.3 Listings may be removed at LilTots' discretion if they breach these Terms, applicable law, or community standards. 5.4 Listings automatically expire after 60 days and may be renewed by the seller. 5.5 Sellers must not include personal contact information (phone numbers, email addresses, social media handles) in listings. 5.6 Boosted listings incur an additional 8% fee on top of the standard commission, payable by the seller. Boosting increases a listing's visibility on the Platform.
6. Prohibited Items
6.1 The following items must not be listed or sold on LilTots under any circumstances: Safety & Health Hazards: • Any item subject to a product recall in Australia — check the ACCC Product Safety Recalls database at productsafety.gov.au/recalls before listing • Items that do not comply with Australian mandatory safety standards • Car seats or baby capsules that are expired, involved in an accident, or more than 10 years old • Cots, bassinets, or sleep products not complying with AS/NZS 2172 or AS/NZS 2195 • Weighted sleep products for children under 12 months • Drop-side cots (banned in Australia) • Baby walkers (banned for sale in Australia) • Items with small parts presenting a choking hazard • Helmets that are cracked, damaged, or have been in a significant impact • Clothing with loose cords or drawstrings longer than 20cm • Button batteries accessible to children without a secure compartment Hygiene & Personal Use Items: • Used breast pumps (electric or manual) • Used bottles of breast milk, formula, or any consumable • Used pacifiers, dummies, or teethers showing significant wear • Used underwear or swimwear (unless brand new with tags) • Used nursing pads, breast shells, or similar personal hygiene items Illegal & Restricted Items: • Any item illegal to sell in Australia • Counterfeit, replica, or unauthorised branded goods • Pharmaceuticals, medications, vitamins, or supplements • Alcohol, tobacco, or any age-restricted products • Weapons of any kind • Items obtained through theft or dishonest means Other Prohibited Items: • Adult content of any kind • Animals or animal products • Hazardous chemicals or materials • Gift cards or vouchers • Digital items or downloads • Items with hateful, discriminatory, or offensive content 6.1b General Consumables Rule: Any consumable product that has been opened, used, or cannot be verified as sealed and unexpired cannot be listed on LilTots. This includes but is not limited to baby food, purees, breast milk, baby formula, infant formula, toddler formula, nappy cream, opened nappies, medications, paracetamol, nurofen, antibiotics, opened creams, opened lotions, opened sunscreen, supplements, vitamins, and probiotics. 6.2 If you are unsure whether an item is permitted, contact us at support@liltotsapp.com before listing. 6.3 Sellers who list prohibited items may have listings removed, receive account strikes, and may be permanently banned. 6.4 Warning system: First violation results in listing removal and a warning. Second violation results in listing removal and a final warning. Third violation results in account suspension pending admin review. LilTots reserves the right to immediately suspend or ban any account without warning where the violation is sufficiently serious.
ACCC Product Safety Recalls — productsafety.gov.au/recalls7. Lucky Dip Clothing Bags
7.1 Lucky Dip Clothing Bags allow sellers to bundle 20 or more pre-loved children's clothing items into a single bag listing. 7.2 The following rules apply specifically to Lucky Dip Bags: • Bags must contain a minimum of 20 individual clothing items • Bags must not be priced above AUD $50 (excluding shipping) • Sellers must accurately state the number of items, gender, size/age range, and season • All items must comply with Australian safety standards • Recalled clothing items must not be included • Used underwear or any prohibited item under clause 6 must not be included 7.3 Buyers who receive a Lucky Dip Bag containing significantly fewer items than listed may raise a dispute under clause 13. 7.4 Sellers with repeated misrepresentation reports on Lucky Dip Bags will lose the ability to create this listing type.
8. Payments and Commission
8.1 All payments for items sold on LilTots must be processed through the Platform using our approved payment provider, Stripe. Off-platform payments are strictly prohibited. 8.2 Requesting, making, or accepting payment outside the Platform ("out-of-app" payment) is a serious breach of these Terms and may result in suspension or termination of your account. 8.3 LilTots charges a commission of 10% of the item sale price (excluding shipping) on every completed transaction. This commission is automatically deducted before funds are released to the seller. 8.4 Boosted listings incur an additional 8% commission fee, totalling 18% for boosted listings. 8.5 Shipping fees are paid by the buyer and are separate from the item price. LilTots does not take commission on shipping fees. 8.6 Payment processing fees charged by Stripe are in addition to LilTots' commission and are passed on to the seller. 8.7 Prices on the Platform are displayed in Australian Dollars (AUD). 8.8 LilTots is not responsible for any currency conversion fees or charges imposed by your bank or payment provider. 8.9 Identity verification fee: sellers who choose to obtain the Verified Human badge must pay a one-time lifetime fee of $2.00 AUD. This fee is non-refundable once the Stripe Identity verification session has been initiated. The fee covers the cost of secure third-party identity verification and is charged once only — sellers may resubmit for verification if their initial attempt is unsuccessful at no additional cost. LilTots reserves the right to revoke verified status if fraudulent activity is detected on the account after verification.
9. LilTots Balance and Escrow
9.1 Funds paid by buyers are held in escrow (the "LilTots Balance") and are not released to the seller until delivery or pickup is verified. 9.2 Fund release conditions: • For pickup orders: funds are released once the buyer scans the seller's QR code or uploads a photo confirming receipt • For shipped orders: funds are released automatically once AusPost tracking confirms delivery, or when the buyer manually confirms receipt 9.3 If a buyer does not raise a dispute within 48 hours of confirmed delivery, funds are automatically released to the seller. 9.4 LilTots holds funds as a service facilitator only and does not operate as a bank or financial institution. 9.5 Available funds may be withdrawn by the seller to their connected Stripe account. Withdrawals are processed within 1–3 business days via your connected Stripe account. 9.6 A minimum withdrawal amount of $5.00 AUD applies. Funds will accumulate in your LilTots Balance until the minimum threshold is reached.
10. Order Fulfilment
10.1 Once a buyer completes a purchase, the order status moves to "Payment Confirmed." The seller is notified immediately via in-app notification and email. 10.2 Sellers must ship the item or arrange pickup within 7 days of payment confirmation. 10.3 For shipped orders, sellers must: • Generate a shipping label and enter a valid AusPost tracking number within 48 hours of payment confirmation • Pack items securely and in a condition consistent with the listing description • Notify the buyer when the item has been dispatched 10.4 For pickup orders, sellers and buyers must coordinate a pickup time and location via the in-app messenger. LilTots recommends using a public location for safety. 10.5 Failure to fulfil an order without reasonable cause may result in account strikes and potential suspension.
11. Buyer Responsibilities
11.1 By purchasing an item on LilTots, you acknowledge and agree that: • LilTots is a peer-to-peer marketplace and items are sold by individual private sellers, not LilTots • You are purchasing at your own risk and LilTots is not responsible for the quality, safety, accuracy, or fitness for purpose of any item • You have read and accepted the item description and photos before purchasing • You will raise any disputes through the in-app dispute process within 48 hours of confirmed delivery • You will not attempt to contact sellers outside of the Platform or arrange off-platform payments 11.2 This clause does not limit any rights you may have under the Australian Consumer Law that cannot be excluded.
12. Seller Responsibilities
12.1 By listing and selling an item on LilTots, you confirm that: • You have accurately described the item's condition, including any faults, damage, or wear • All photos accurately represent the item being sold • You will complete the sale to the buyer who has purchased the item • The item is safe, legal, and not prohibited under these Terms • You will not attempt to conduct any part of the transaction outside of the Platform 12.2 Failure to accurately describe an item's condition, failure to fulfil an order, or any attempt to deceive a buyer may result in account suspension or permanent ban.
13. Disputes, Refunds and Returns
13.1 If a buyer believes an item received does not match its description, is significantly not as described, or is faulty, they may raise a dispute within 48 hours of confirmed delivery through the in-app dispute process. 13.2 Disputes must include: • The reason for the dispute (selected from the provided categories) • Photos clearly showing the issue • A written description of the problem 13.3 LilTots will review all disputes and may request additional information from either party. LilTots' decision on disputes is final. 13.4 LilTots acts as a mediator only and is not obligated to provide refunds from its own funds. Where a dispute is found in favour of the buyer, funds held in escrow will be returned to the buyer rather than released to the seller. 13.5 LilTots' involvement in disputes does not limit your rights under the Australian Consumer Law. 13.6 Where a dispute cannot be resolved through the Platform, you may contact Consumer Affairs in your state or territory, or the Australian Competition and Consumer Commission (ACCC). Refunds and Returns Policy: 13.7 LilTots operates an escrow-based payment system designed to protect both buyers and sellers. 13.8 If a dispute is resolved in the buyer's favour: the full item price paid by the buyer (excluding any shipping fees already incurred) will be returned to the original payment method used at checkout (Stripe). Refunds are processed within 5–10 business days depending on your payment provider. 13.9 Shipping fees are non-refundable unless the item was never dispatched by the seller. 13.10 If a dispute is resolved in the seller's favour: funds held in escrow are released to the seller's LilTots Balance immediately. 13.11 Unresolved disputes: if a dispute has not been resolved within 14 days of being formally submitted through the app, LilTots will make a final determination based on the available evidence. Funds will not be held in escrow indefinitely. The 14-day clock begins from the date the dispute was formally submitted. 13.12 LilTots does not offer change-of-mind refunds. All sales are final unless the item received is significantly not as described, faulty, or unsafe. 13.13 Items that do not match their listed condition, are missing parts described in the listing, or are unsafe for the age group listed may be eligible for a refund at LilTots' discretion following a dispute review. 13.14 Sellers are not required to accept returns unless a dispute is formally raised and resolved in the buyer's favour through the LilTots dispute process. 13.15 Buyers and sellers must not arrange refunds or returns outside of the Platform.
14. Reviews and Ratings
14.1 Buyers may leave a star rating (1–5) and written review for sellers after a completed transaction. 14.2 Reviews must be honest, accurate, and based on your genuine experience of the transaction. 14.3 Reviews must not contain personal attacks, defamatory statements, false information, or content that violates these Terms. 14.4 LilTots reserves the right to remove reviews that violate these Terms. 14.5 Sellers may respond to reviews. Responses must be professional and must not contain abusive or defamatory content.
15. Account Suspension and Termination
15.1 LilTots may issue warnings, account strikes, temporary suspensions, or permanent bans for breaches of these Terms, including but not limited to: • Listing or selling prohibited items • Conducting off-platform payments • Scamming, fraud, or dishonest conduct • Misrepresentation of items • Commercial selling in breach of clause 4 • Abusive, threatening, or harassing conduct toward other users • Repeated disputes or buyer complaints • Any illegal activity 15.2 Strike consequences: • 1 strike: written warning via in-app notification and email • 2 strikes: listings temporarily hidden pending account review • 3 strikes: permanent account suspension and removal of all listings 15.3 LilTots reserves the right to permanently ban any account without warning where the conduct is sufficiently serious, including fraud, scamming, listing recalled or dangerous items, or illegal activity. 15.4 Users who are permanently banned must not create a new account. Creating a new account after a ban is a breach of these Terms.
16. Account Deletion
16.1 You may delete your account at any time via the Settings menu in the app. 16.2 A 30-day grace period applies before permanent deletion. During this period you may reactivate your account by logging in. 16.3 After 30 days, all personal data associated with your account will be permanently deleted, except where retention is required for dispute resolution, legal compliance, or as permitted by our Privacy Policy. 16.4 Pending transactions must be resolved before account deletion. LilTots will not release held funds to an account pending deletion until all disputes are resolved.
17. Messaging and Communication
17.1 LilTots provides an in-app messaging system for buyers and sellers to communicate about transactions. 17.2 Users must not use the messaging system to: • Share personal contact information including phone numbers, email addresses, or social media handles • Arrange off-platform payments • Send spam, unsolicited messages, or promotional content • Send abusive, threatening, or harassing messages 17.3 LilTots uses automated content filtering to detect prohibited content in messages. Repeated violations may result in account suspension.
18. Intellectual Property
18.1 The LilTots name, logo, branding, and all content on the Platform (excluding user-generated content) is owned by LilTots Pty Ltd and is protected by Australian and international intellectual property laws. 18.2 By uploading photos or other content to the Platform, you grant LilTots a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content for the purposes of operating and promoting the Platform. 18.3 You confirm that you own or have the right to use any content you upload to the Platform, and that it does not infringe any third-party intellectual property rights.
19. Privacy
19.1 LilTots collects, uses, and discloses personal information in accordance with our Privacy Policy, which is available at https://liltotsapp.com/privacy and forms part of these Terms. 19.2 By using the Platform, you consent to the collection and use of your personal information as described in the Privacy Policy.
20. Limitation of Liability
20.1 To the maximum extent permitted by law, LilTots excludes all liability for any loss or damage (including direct, indirect, consequential, or incidental loss) arising from your use of the Platform or any transaction conducted through the Platform. 20.2 LilTots is not liable for: • Items that are not as described, faulty, or unsafe • Loss or damage caused by a seller's failure to fulfil an order • Loss or damage caused during shipping or pickup • Any technical failures, outages, or interruptions to the Platform • Unauthorised access to your account 20.3 Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot be excluded.
21. Australian Consumer Law
21.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. 21.2 Nothing in these Terms is intended to exclude, restrict, or modify rights you may have under the Australian Consumer Law or any other applicable consumer protection law.
22. Changes to These Terms
22.1 LilTots may update these Terms from time to time. We will notify you of material changes via in-app notification and email at least 14 days before the changes take effect. 22.2 Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the updated Terms. 22.3 If you do not agree to the updated Terms, you must stop using the Platform and may delete your account.
23. Governing Law and Disputes
23.1 These Terms are governed by the laws of Queensland, Australia. 23.2 Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia. 23.3 LilTots encourages users to contact us at support@liltotsapp.com to resolve any issues before commencing formal proceedings.
